By accessing or using Fix Tech Stuff, you agree that this document constitutes both the Terms of Service governing your use of the service and the Privacy Policy governing the collection, use, and disclosure of your personal information. Your continued use constitutes acceptance of all terms and privacy practices described herein.
In the event that any provision of this agreement is held to be invalid or unenforceable the remaining provisions shall remain in full force and effect.
Severability
If any provision of this Agreement is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the fullest extent permitted by law. The invalid, illegal, or unenforceable portion shall be deemed modified to the minimum extent necessary to make it enforceable and to carry out the parties’ intent, and the remaining provisions shall remain in full force and effect.
Payment Before Release.
Services and device access are withheld until all fees are paid in full. No work will be performed, and no devices will be released prior to full payment.
Recording and Use of Recordings
You acknowledge and consent that Fix Tech Stuff may record audio and video of repairs (“Recordings”) and retain such Recordings indefinitely. Recordings may be used for: (a) internal quality control, staff training, and chargeback/fraud resolution; and (b) commercial purposes (advertising, promotional materials). Fix Tech Stuff will take commercially reasonable steps to obscure personally identifiable information (PII) prior to public/commercial use but disclaims liability for any unintended disclosure of PII. To opt out of commercial use, you must provide written notice to Fix Tech Stuff prior to public release; Fix Tech Stuff will use commercially reasonable efforts to exclude opted-out Recordings from commercial use.
Refunds; Payments
Fix Tech Stuff does not issue refunds. Payments made for parts, diagnostics, and labor will be retained by Fix Tech Stuff unless a refund is expressly required by applicable law. You accept and assume the risk of unsuccessful repairs and remain responsible for payment for services rendered, except where a refund is mandated by law.
Acknowledgment of Risk; Limitation of Liability; Customer Responsibility
Customer acknowledges the risk of data loss, hardware damage, software malfunctions, and other issues during or after service. Customer is responsible for backing up all data and removing confidential or proprietary information prior to service. Fix Tech Stuff disclaims all warranties, express and implied, regarding the success of services. Except to the extent caused by Fix Tech Stuff’s gross negligence or willful misconduct, Fix Tech Stuff shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including loss of data or profit. Customer agrees to indemnify and hold Fix Tech Stuff harmless for claims arising from Customer’s failure to back up or secure data.
Termination; Retention and Abandoned Devices
Fix Tech Stuff may suspend or terminate services at any time for breach of these Terms or unlawful conduct. Upon termination, Fix Tech Stuff is not obligated to complete work or return devices until outstanding charges, storage fees, and lawful disposition costs are paid. If a device is not retrieved after at least three documented attempts to contact the customer (telephone, email, and mailed notice) and a minimum retention period of 30 days has elapsed, Fix Tech Stuff may deem the device abandoned and may sell or otherwise dispose of it. Proceeds will first be applied to outstanding charges, storage, and disposition costs; any remaining balance will be remitted to the customer upon verified request within 60 days. Fix Tech Stuff may extend retention periods at its discretion.
Sale / Disposition Procedure
When selling an abandoned device Fix Tech Stuff will: (1) document attempts to contact the customer; (2) sell by commercially reasonable means; (3) apply sale proceeds to outstanding balances and documented costs; and (4) provide an accounting on request. Customer remains responsible for any deficiency. Fix Tech Stuff’s sale/disposition rights are subject to the notice and accounting obligations above.
Training Use
By submitting a device for repair you consent that Fix Tech Stuff staff may, while servicing your device, use the device for training and demonstration purposes. You assume all risk for any damage resulting from training activities and indemnify Fix Tech Stuff against related claims, except to the extent caused by Fix Tech Stuff’s gross negligence or willful misconduct.
Customer-Supplied Parts
Fix Tech Stuff generally declines customer-supplied parts due to inability to verify warranty or compatibility. If accepted after explicit consultation with a technician, you assume responsibility for incorrect or incompatible parts, including all return/shipping costs; no compensation will be provided by Fix Tech Stuff for incorrect parts.
Transport and Transfer of Devices
Fix Tech Stuff may move, ship, transfer, or transport devices between facilities or to third-party repair shops as needed to complete repairs. All shipping and transport are at the customer’s sole risk. Fix Tech Stuff assumes no liability for loss, theft, or damage to devices during carrier transport or while in third-party custody. Responsibility for any claims rests entirely with the customer and the carrier or third party.
Chargebacks, Collections, and Fraud Response
If you initiate a chargeback, Fix Tech Stuff will contest the chargeback and seek recovery of reasonable and documented costs (parts, labor, chargeback fees, collection expenses). You authorize Fix Tech Stuff to share transaction and repair data with payment processors, collections agencies, or law enforcement for dispute resolution or collection. Fix Tech Stuff may treat fraudulent chargebacks as fraud and pursue lawful remedies; any recovery sought will be limited to actual costs reasonably incurred and lawful fees.
Data Handling and Transfers
Fix Tech Stuff does not sell personal data. Personal data is collected solely to provide services, process payments, and communicate about repairs. Fix Tech Stuff will only share contact or repair-related information with third-party repair shops or service providers when: (a) you explicitly opt-in during the quote process; (b) the disclosure is necessary to perform the repair; or (c) required by law. Access to personal data within Fix Tech Stuff is limited on a need-to-know basis and protected by reasonable administrative and technical safeguards. Customer data may be shared when necessary for chargeback resolution, collections, or legal compliance.
Illegal Content; Reporting
If Fix Tech Stuff discovers illegal material on a device (including CSAM or contraband), Fix Tech Stuff will preserve evidence and report to law enforcement and may transfer relevant materials to authorities as required by law. Fix Tech Stuff reserves the right to cooperate fully with investigations.
False Information / Fraud Policy
Fix Tech Stuff will pursue legal remedies for intentional fraudulent activity, including knowingly submitting false payment information, impersonation, or materially false statements intended to obtain services.
Right to Communications Discretion
Fix Tech Stuff reserves the right, in its sole discretion, to decline to respond to inquiries or quotes.
Fix Tech Stuff reserves the right, in its sole discretion, to to work only on computer software or hardware issues.
Use of AI
Fix Tech Stuff may use automated systems or AI tools to manage bookings, handle incoming calls, or for other business functions. AI may process personal data where necessary; Fix Tech Stuff is not responsible for third-party AI errors beyond commercially reasonable verification measures.
Arbitration; Waiver of Jury Trial and Class Actions
You and Fix Tech Stuff agree that any dispute, claim, or controversy arising out of or relating to this Agreement or the services provided will be resolved by final and binding arbitration, and you and Fix Tech Stuff expressly waive the right to a jury trial and to participate in a class action, class arbitration, or representative action. You may opt out of arbitration within thirty (30) days after a repair is started by notifying Fix Tech Stuff in writing. Small claims actions may be pursued in small claims court by either party. The arbitrator may award any relief allowed under applicable law. This arbitration clause is intended to preclude litigation except as permitted herein.
Data Retention; Erasure; Disposal
Fix Tech Stuff retains customer data only as necessary to provide services, resolve disputes, meet legal obligations, and for a reasonable post-service retention period. Fix Tech Stuff may securely erase backups or copies of data after service completion and after the retention period. Fix Tech Stuff is not liable for loss of data resulting from such erasure, except to the extent caused by Fix Tech Stuff’s gross negligence or willful misconduct.
Entire Agreement; Modification
This Agreement constitutes the entire agreement between you and Fix Tech Stuff concerning the subject matter and supersedes prior agreements. Fix Tech Stuff may modify these Terms at any time by posting a revised version on its website; continued use of services after posting constitutes acceptance of the revised Terms.
