Acknowledgment of Risk
Customer acknowledges that the use of computer repair and technical support services involves certain risks, including but not limited to data loss, hardware damage, software malfunctions, and other unforeseen issues that may arise during or after the service is provided.
No Warranty The Service Provider makes no warranties, express or implied, regarding the success of the services provided. The Service Provider does not guarantee that any particular outcome will be achieved, including but not limited to the complete recovery of data or the flawless functioning of the hardware or software after the service is performed.
Limitation of Liability In no event shall the Service Provider be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of the services provided, including but not limited to loss of data, loss of profit, or any other loss or damage arising out of or in connection with the services performed, even if the Service Provider has been advised of the possibility of such damages.
Indemnification Customer agrees to indemnify and hold harmless the Service Provider, its officers, employees, and agents, from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of or in any way connected with the services provided by the Service Provider.
Customer's Responsibility Customer is responsible for backing up all data and removing any confidential, proprietary, or personal information from the device before the Service Provider performs any services. The Service Provider will not be held responsible for any loss or corruption of data or any security breach of sensitive information.
Who can use Fix Tech Stuff
To use Fix Tech Stuff, you must meet the minimum age requirement of 16. Additionally, individuals under 16 must be accompanied by an adult when using our services, and must sign in their name with a card matching their legal name.
What Is Fix Tech Stuff
Fix Tech Stuff is a white label repair service. Similar to popular service based apps we facilitate repairs.
We do not have a physical location.
Right To Train
Staff members at Fix Tech Stuff may undergo training to develop their skills in repairing electronic devices, including while working on your devices.
We do not sell your personal information.
We may collect and use your data within Fix Tech Stuff to contact you for communications from Fix Tech Stuff.
Right to refuse
Fix Tech Stuff reserves the right to refuse service to any customer.
Right to Communication Discretion
Fix Tech Stuff reserves the right to decline to respond to any inquiries or requests for quotes at our sole discretion without providing a reason.
Right To Refuse Parts
We've decided to generally decline customer-supplied parts due to the inability to verify their guarantee or obtain invoicing information. Allowing Fix Tech Stuff to find parts ensures the integrity of our repairs. Historically, customer-supplied parts have led to fitting issues, inferior quality, or manufacturing defects, causing frustration for both customers and repair technicians. Consequently, we typically do not accept repairs with customer-provided parts.
However, there's an exception if you've consulted with a repair technician regarding providing your own parts. In such cases, you understand that if the parts are incorrect or rejected, the return process is your responsibility, and you'll need alternative parts for the repair. Even if you purchase incorrect parts, you'll still require suitable replacements to repair the device. We strongly advise discussing part options with a repair technician before making any purchases.
Right To Return Devices Any State
Fix Tech Stuff reserves the right to return devices in any device state including non working
Right to Termination of Service
Fix Tech Stuff reserves the right to terminate or suspend services to any Customer who breaches these Terms or engages in unlawful activities. In the event of termination, Fix Tech Stuff is not obligated to secure or return any devices or data. The Customer remains responsible for retrieving their device and data, if possible.
Right to Request and Or Refuse Submitted Quote.
Fix Tech Stuff reserves the right to refuse to start any repair work until a quote has been submitted. This process ensures that customers have reviewed and accepted our terms, and also ensures accurate documentation in our ticketing system before work can commence. Fix Tech Stuff reserves the right to modify or cancel any submitted quote at any time including billing.
Right to contact
You agree to allow Fix Tech Stuff to contact you for cell phone repairs or billing issues. Information given to Fix Tech Stuff may be used to contact you about your device or bill.
Right to transfer
Repair shops not affiliated with Fix Tech Stuff may be given customer info should you choose this option when starting a quote.
It is up to the repair shop to use that customer phone number and name to reach out to the customer. Prices given from Fix Tech Stuff may not align with what another repair shop would give.
As a example of this if we are all out of screens for a particular phone and a customer wants a repair done we may reach out to a repair shop and transfer that customer to them. When a quote is submitted customers are asked if they allow transfer to another repair shop. If a customer chooses no Fix Tech Stuff will not transfer that customer.
responsibilities or liabilities of lost or damaged items fall on the shipping carrier. To be clear you must choose the option to be transferred and will be asked if this is a suitable option. Once transferred the repair company will be given your name and phone number and may call you back. Pricing quotes from Fix Tech Stuff will not transfer.
Right to transport
Fix Tech Stuff may move, ship, transfer, or transport your items from one location to another.
Right to agreed payment
Fix Tech Stuff retains the right to only work when the agreed amount is paid.
If the incorrect option is picked Fix Tech Stuff will await further payment before beginning services or may cancel payments.
Please note: Fix Tech Stuff does not issue refunds.

Any payments made will be kept unless required return by law.
Pay Later
Fix Tech Stuff gives the option of using pay later. This option allows you to obtain a repair and pay for the cost over time. Fix Tech Stuff is not the collector of any debt created using Pay Later.
Right to deny refunds
Refunds: Fix Tech Stuff does not give refunds unless required by law. We charge for parts to repair and time spent on repair.
Right to Fight Charge-Backs And Collect Payment.
Fix Tech Stuff may pursue unpaid debts to the fullest extent of the law.
In the event a customer issues a charge-back Fix Tech Stuff may fight the charge-back to a cost far outweighing the repair that was started.

Fix tech stuff may treat chargebacks as fraud and pursue for damages.
Personal Data Handling
Personal Data is only collected for the purpose of providing services or handling payments.

Unless required by law or to perform a required action (example payment info shared with payment processor) we do not share personal data outside Fix Tech Stuff.

While control of user data is audited within Fix Tech Stuff, repair techs may have access to information required to contact a customer for a repair unless required by law. We do not knowingly share your information and will not sell your data. User data collected will remain with Fix Tech Stuff and will be manually be encrypted when not required. In short: Fix Tech Stuff can access and use any data shared or given to us for the sole purpose of repair or contacting a customer for payments. While customer data is not used for training purposes with repair techs, video footage of repairs is.
Right To Communications
By using our services, the Customer acknowledges that Fix Tech Stuff may contact them electronically or otherwise regarding payment issues, including but not limited to overdue balances, collections, and related matters. The Customer agrees to receive such communications, which may include notifications and updates related to their account status. Failure to address payment issues may result in referral to a collections agency.
Fake Information Policy
Fix Tech Stuff reserves the right to prosecute for wrongful information being submitted including but not limited to
Attempting to file false or fraudulent payment methods
Pretending to know people within the company with intent of obtaining employee or friends pricing.
Right to record and retain
Every repair may be video recorded. we may video record repairs with the intent of retaining proof of repair as long as deemed necessary.
You understand that video being used may be saved indefinitely, and is used for further staff training or public education on repairs or shared with financial services to dispute charge-back instances. We also retain the right to store or keep contact records related to your repair including but not limited to customer phone numbers and email addresses
Right to Re-Fix
In the event a tech makes mistakes during your repair we reserve the right to work with the customer on options to correct that repair.
Right to sell
In the event we are unable to reach you after repairing a device, if after multiple attempts to contact you over a period of time with no response on your end we may eventually sell your repaired devices after wiping them clean. Our current policy for keeping devices is 30 days however this timeframe can be extended by staff.
Right To Record
Fix Tech Stuff reserves the right to use video recordings of electronic repairs for any purpose, including internal and commercial uses. This includes:
Internal Use: Video recordings may be used for internal purposes such as staff training and chargeback resolution. Fix Tech Stuff has full discretion over these recordings and how they are used internally. Customers cannot opt out of internal use. While we will take measures to obscure Personal Identifiable Information (PII), Fix Tech Stuff is not liable for any unintended disclosure or issues arising from these recordings. Internal recordings will not be shared or sold to third parties outside of necessary chargeback and collections processes.
Commercial Use: Video recordings may also be used for commercial purposes, including advertising and promotional content. Fix Tech Stuff retains full control over the commercial use of these recordings. Customers may opt out of having their video recordings used for commercial purposes by notifying Fix Tech Stuff in writing. We will honor such requests and exclude opted-out videos from commercial use.

While we will make efforts to protect PII, Fix Tech Stuff disclaims all liability for unintended exposure or other consequences. By agreeing to these Terms, you acknowledge and accept that all risks related to the use of video recordings are your own.
Data Sharing: Fix Tech Stuff does not share customer data outside of what is necessary for chargebacks and collections. Fix Tech Stuff does not sell customer data.
Use Of AI: Fix Tech Stuff may use Ai to manage bookings & handle incoming calls.

Fix Tech Stuff may place tiny stickers inside your device used to identify repairs done by Fix Tech Stuff or to acquire new talent.
Right to publish
we may publish details or instructions from your repair on our website to assist further customers. Any published content will not include details identifying customers or personal data.
Right to erase or destroy
You understand that repairing devices comes with risks and do not hold Fix Tech Stuff accountable in the event your device is damaged or data is lost. Fix Tech Stuff will never knowingly cause harm to your devices.
Customer data is encrypted and kept within archives IF required for repair. Information not related to assisting a customer is destroyed after it is no longer needed. Example: photos during a transfer will be destroyed once given to customer, call logs and chats with the repair tech may be kept.
Right to report
In the event illegal activities are found on your device during repair Fix Tech Stuff will report to authorities and/or hand over any materials.
AI generated CSAM will be treated as illegal material.
Right To Update : Modification of Terms
Fix Tech Stuff reserves the right to modify or update these Terms of Service at any time. Any changes will be effective immediately upon posting on our website. Continued use of our services after changes have been posted constitutes acceptance of the modified terms.
Shipping Agreements
In the event of a Shipping failure you will be required to contact shipping provider.

ARBITRATION STATUS DOES NOT WAIVE OUR NO REFUND POLICY OR STANCE ON REFUSING SERVICES.
Additional Rights You Grant Us
You agree not to harm anyone with the Fix Tech Stuff branding and understand our policy on Harassment.
Fix Tech Stuff reserves the right to close your account or refuse service at any time. any actions intent to shame, deceive or insult or harass repair techs working with your electronics will result in items being returned or transported/mailed to the nearest police station in existing condition including but not limited to a non-working device order and may result in police action depending on the actions taken. Fix Tech Stuff employees staff or contractors may be of any race or gender or come from all walks of life and harassment may be prosecuted.
You agree, to the extent permitted by law, to indemnify, defend, and hold harmless Fix Tech Stuff, our affiliates, directors, officers, stockholders, employees, licensors, and agents from and against any and all complaints, charges, claims, damages, losses, costs, liabilities, and expenses (including attorneys’ fees) due to, arising out of, or relating in any way to: (a) your access to or use of the Services, or any products or services provided by a third party in connection with the Services, even if recommended, made available, or approved by Fix Tech Stuff; (b) your content, including infringement claims related to your content; (c) your breach of these Terms or any applicable law or regulation; or (d) your negligence or willful misconduct.
Repair Standards.
While Fix Tech Stuff prides itself on striving for excellence in repair services, it is imperative to clarify that the limitations we face are imposed by Apple, not by our own choice. Our specialization lies in repairing Apple devices, and we diligently work to uphold a high-level repair standard for these products.
However, it is crucial to acknowledge that certain aspects, such as TouchID repairs, are beyond our scope. TouchID functionality is intricately tied to Apple's proprietary technology, and as a result, repairs for this specific feature are exclusively performed by authorized Apple service providers. Unfortunately, we are not authorized to address TouchID-related issues.
Moreover, despite our best efforts in repairing Apple devices, there is a possibility that certain devices may encounter error messages after the repair process. These error messages can stem from various factors, including complex software or hardware interactions that may not be fully resolved during the repair. We strive to minimize such occurrences through meticulous attention to detail and rigorous quality control, but it is important to acknowledge the inherent complexities involved in device repairs.
Billing
Fix Tech Stuff uses PayPal for billing. We collect email as part of the quote process and use that email to send billing notices.
We do not give standardized billing as all repairs can vary in parts, travel distance or other factors.
Beacons
By default PayPal invoicing uses a web beacon within invoices letting us know if the bill was viewed.

Additional terms
This Agreement constitutes the entire agreement between you and Fix Tech Stuff and governs your use of the Services superseding any prior agreements between you and Fix Tech Stuff. If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect .Fix Tech Stuff reserves the right to modify or update these terms of service at any time without prior notice. Your continued use of the following services of Fix Tech Stuff following any changes to these terms of service will constitute your acceptance of such changes
Definition of Customer
Any individual or entity who interacts with or engages with our services or products, regardless of whether a transaction has been completed or payment has been received. This includes potential, prospective, and current users or clients.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision will be interpreted in a manner that most closely aligns with the intent of the original provision.
Force Majeure
Fix Tech Stuff shall not be liable for any failure to perform its obligations under this Agreement if such failure is due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, pandemics, or other events of force majeure.
This Agreement constitutes the entire agreement between the Customer and Fix Tech Stuff and supersedes all prior agreements and understandings, whether written or oral, related to the subject matter hereof.
